Where the J-1 Cannot Go
Some fields and workplaces are excluded from the J-1 by federal regulation, no matter how well the training plan is written. Knowing the exclusions early stops you building a case that can never be approved.
What fields are prohibited on the J-1 visa?
The J-1 Intern and Trainee program excludes unskilled or casual labour, child care and elder care, clinical roles with direct patient contact, positions with staffing agencies, and any role that is more than 20 percent clerical. These exclusions are set in 22 CFR 62.22(j) and apply regardless of how the training plan is written.
The federal exclusions
The Department of State rules rule out entire categories. The program cannot be used for:
- unskilled or casual labour,
- child care or elder care,
- clinical work with direct patient contact, including nursing, therapy, dentistry, veterinary care, social work, speech therapy, and early childhood care,
- positions with staffing or temp agencies, and
- roles that are more than 20 percent clerical.
Prohibited fields
Certain fields are excluded outright. A selection:
- animal and child care, elder care,
- clinical roles and psychological counselling,
- social work, sports, physiotherapy and coaching,
- teaching, multi-level marketing,
- trades and crafts such as pottery or carpentry, and veterinary work.
Prohibited workplaces
Beyond fields, certain workplaces are off limits regardless of role. A selection:
- agriculture and vineyard harvest work,
- arcades, retail and boutiques, convenience stores and groceries,
- call centres, customer service and help desks,
- fast food, gyms, fitness, dance and coaching studios,
- gas stations, landscaping, real estate offices,
- schools, spas and salons, and staffing agencies.
For many of these cases the right route is Work and Travel rather than Career Training. License-based or commission-based training is also not permitted.
How these lists connect to the federal rules
These exclusions are not separate rules. They are the concrete version of the federal limits set by the US Department of State. We review your field and workplace against them case by case, so the underlying federal limits are always what decides it.
Where the J-1 does work well
Plenty of strong niches remain. The J-1 is a natural fit for engineering, finance, business administration, IT, architecture, and hospitality management, among others. If your field is on the safe side of the line, the task becomes building a strong training plan rather than checking eligibility.
