Reasons for Termination

Under 22 CFR § 62.40(a), your sponsor must terminate participation if you fail to pursue the activities for which you were admitted; cannot continue, unless an exception applies; violate program regulations or sponsor rules sufficiently to warrant termination in the sponsor's opinion; or willfully fail to maintain required insurance.

Unauthorized employment is also grounds for termination. Section 62.40(b) requires the State Department to terminate participation when it establishes that violation.

What Happens in SEVIS

Your sponsor must promptly record involuntary termination in SEVIS, using the Effective Date of Termination. The record changes to "Terminated". This prevents the sponsor from subsequently extending your participation, transferring you to another program or changing your category.

If your participation is terminated for just cause, the State Department says you are expected to depart immediately. You do not receive the post-completion Grace Period.

Not Every Early Ending Is Termination

Sponsors must not terminate the program of someone who voluntarily ends participation. State Department guidance distinguishes shortening a program for non-disciplinary reasons, including medical problems, from termination.

Normal completion allows 30 days to depart or seek to maintain lawful status, measured from the program end date or four-year admission limit, whichever comes first. If the program end date is shortened, the 30 days run from the new date. That is different from termination for just cause.

FAQs

Can a sponsor threaten termination because I complained?

No. A sponsor cannot threaten termination or otherwise retaliate solely because you made a complaint or sought outside assistance about a grievance.

The Bottom Line

Termination is not an ordinary program ending. It changes your SEVIS record and removes the usual post-completion grace period.
